OREF Understanding Transaction Contingencies

There are a variety of contingencies described in the OREF Residential Real Estate Purchase Agreement. The removal of these contingencies, whether by action or by silence, is an important factor towards moving the transaction to the closing table. Each contingency found in the sale agreement has specific requirements that must be met before the contingency will be removed.

OREF Townhome, Planned Community, and Homeowners Association Addendum

The Townhome / Planned Community / Homeowners Association Addendum, OREF Form 024, is used when a property is located within a community subject to a homeowners association. HOAs can have limitations on property use that buyers must be aware of before proceeding with the sale transaction. This addendum to the OREF Residential Purchase and Sale Agreement requests that the seller give the buyer the proper documents that cover the HOA rules. These documents can include CC&Rs, HOA articles and bylaws, meeting minutes, rules and regulations, HOA reserve funds, and so on.

This 1-hour video course explains the homeowners association addendum as well as issues that might arise when utilizing the addendum in your purchase offer paperwork. The course is presented by Jeffry Wiren of Premier Property Group, LLC, and Steve Russell of Windermere Stellar (and current chairperson of the OREF Forms Committee), with section introductions by Jeff Sorg of OnlineEd. OREF Financing Contingency Clause

The financing contingency in the OREF Residential Real Estate Purchase Agreement lays out the information that the buyer is submitting to the seller regarding the buyer’s ability to purchase the seller’s property. This contingency covers what is to happen finance-wise when an all-cash offer is presented to the seller, or what is to occur with regards to the balance of the purchase price being offered. This section of the purchase offer form also covers what happens when there is a failure of the financing contingency.
